CANCELLATION POLICIES

Even-though our technologies connect our users for business’ purposes, we believe our users’ relationships are above all, human relationships. We treat and consider every Job Provider and Job Applicant, as members of our community and just like we would with family members.

Similarly, as in a family-type environment, mistakes and bad behaviors must be corrected.

Therefore, as head of the family, INSTIRE has the same responsibilities towards its members and must apply certain rules, thus sanctions BUT also give the opportunity to forgive.

For the better good of the community and to ensure the best service possible, we’ve started to establish INSTIRE’s cancellation policies and we encourage every member to strictly comply with them.

  • On one hand, Job Applicants may withdraw from jobs occasionally and that could cause some inconvenience to Job Providers who are expecting jobs/shifts to be provided on schedule;
  • On the other hand, Job Providers may also need to cancel jobs from time to time and that could have an incidence on Job Applicants who were expecting to work and receive payment.

Those cancellation policies won’t apply if Job Providers/Job Applicants are able to submit a proof of Force Majeure that would be accepted by INSTIRE. For purposes of clarity, Force Majeure shall mean when “failure or delay is caused by or results from causes beyond the reasonable control of the affected party, including, but not limited to fire, floods, embargoes, war, acts of war (whether war be declared or not), acts of terrorism, insurrections, riots, civil commotions, strikes, lockouts or other labor disturbances, acts of God or acts, omissions or delays in acting by any governmental authority or the other party.

 

I – For JOB PROVIDERS

If a Job Provider cancels a job/shift for which he/she/it hired at least one Job Applicant through our Platform, cancellation shall ONLY be made via the Platform. The following penalty points to the Job Provider’s account will apply, depending on the different hiring urgency levels:

A – Job with “LATER” hiring urgency level:

  • 1 (one) penalty point if the cancellation occurs between 15 (fifteen) hours and 10 (ten) hours before Job Start Time
  • 2 (two) penalty points if the cancellation occurs between 10 (ten) hours and 5 (five) hours before Job Start Time
  • 3 (three) penalty points if the cancellation occurs less than 5 (five) hours before Job Start
  • 5 (five) penalty points if the Job Provider does not cancel the job via the Platform when such hired Job Applicant reports this breach to INSTIRE

B – Job with “TOMORROW” hiring urgency level:

  • 1 (one) penalty point if the cancellation occurs between 10 (fifteen) hours and 5 (five) hours before Job Start Time
  • 2 (two) penalty points if the cancellation occurs between 5 (five) hours and 2 (two) hours before Job Start Time
  • 3 (three) penalty points if the cancellation occurs less than 2 (two) hours before Job Start Time
  • 5 (five) penalty points if the Job Provider does not cancel the job via the Platform when such hired Job Applicant reports this breach to INSTIRE

C – Job with “TODAY” hiring urgency level:

  • 1 (one) penalty point if the cancellation occurs between 5 (five) hours and 2 (two) hours before Job Start Time
  • 2 (two) penalty points if the cancellation occurs between 2 (two) hours and 1 (one) hour before Job Start Time
  • 3 (three) penalty points if the cancellation occurs less than 1 (one) hour before Job Start Time
  • 5 (five) penalty points if the Job Provider does not cancel the job via the Platform when such hired Job Applicant reports this breach to INSTIRE

D – Job with “NOW” hiring urgency level:

  • 2 (two) penalty points if the cancellation occurs no more than 15 minutes after hiring is confirmed
  • 3 (three) penalty points if the cancellation occurs more than 15 minutes after hiring is confirmed
  • 5 (five) penalty points if the Job Provider does not cancel the job via the Platform when such hired Job Applicant reports this breach to INSTIRE

 

When 10 penalty points are reached, such Job Provider account shall be suspended for a 1 (one) month period and all jobs/shifts posted (if apply) shall be cancelled and removed from our database. The account shall then be re-activated after the one (1) month period, with a one (1) star loss in such Job Provider’s ratings. After reactivation, if for the following 3 (three) uses of our Platform a penalty point applies to such Job Provider’s account, this account shall be suspended indefinitely (with the exception of a Force Majeure proof submitted and accepted by our Platform).

 

II – For JOB APPLICANTS

If a Job Applicant cancels a job/shift for which he/she/it was hired through our Platform, such cancellation shall be made ONLY via the Platform. The following penalty points to the Job Applicant’s account will apply, depending on the different hiring urgency levels:

A – Job with “LATER” hiring urgency level:

  • 1 (one) penalty point if the cancellation occurs between 15 (fifteen) hours and 10 (ten) hours before Job Start Time
  • 2 (two) penalty points if the cancellation occurs between 10 (ten) hours and 5 (five) hours before Job Start Time
  • 3 (three) penalty points if the cancellation occurs less than 5 (five) hours before Job Start Time
  • 5 (five) penalty points if the Job Applicant does not cancel the job/shift via the Platform when the Job Provider reports this breach to INSTIRE

B – Job with “TOMORROW” hiring urgency level:

  • 1 (one) penalty point if the cancellation occurs between 10 (fifteen) hours and 5 (five) hours before Job Start Time
  • 2 (two) penalty points if the cancellation occurs between 5 (five) hours and 2 (two) hours before Job Start Time
  • 3 (three) penalty points if the cancellation occurs less than 2 (two) hours before Job Start Time
  • 5 (five) penalty points if the Job Applicant does not cancel the job/shift via the Platform when the Job Provider reports this breach to INSTIRE

C – Job with “TODAY” hiring urgency level:

  • 1 (one) penalty point if the cancellation occurs between 5 (five) hours and 2 (two) hours before Job Start Time
  • 2 (two) penalty points if the cancellation occurs between 2 (two) hours and 1 (one) hour before Job Start Time
  • 3 (three) penalty points if the cancellation occurs less than 1 (one) hour before Job Start Time
  • 5 (five) penalty points if the Job Applicant does not cancel the job/shift via the Platform when the Job Provider reports this breach to INSTIRE

D – Job with “NOW” hiring urgency level:

  • 2 (two) penalty points if the cancellation occurs no more than 15 minutes after hiring is confirmed
  • 3 (three) penalty points if the cancellation occurs more than 15 minutes after hiring is confirmed
  • 5 (five) penalty points if the Job Applicant does not cancel the job/shift via the Platform when the Job Provider reports this breach to INSTIRE

 

When 10 penalty points are reached, such Job Applicant’s account shall be suspended for a 1 (one) month period and all job applications made through the Platform (if applicable) shall be withdrawn and all jobs/shifts for which he/she/it was hired (if applicable) shall be cancelled. The account shall then be re-activated with a 1 star loss in such Job Applicant’s ratings. After reactivation, if for the following 3 (three) uses of the Platform a penalty point applies to such Job Applicant’s account, this account shall be suspended indefinitely (with the exception of a Force Majeure proof submitted and accepted by our Platform).
